Arkansas

California

California was the second state to create a mandatory Statutory Disability Insurance (SDI) law in 1946. Paid Family Leave (PFL) was later added in 2004. More information can be found here: CA SDI & PFL

Colorado

Colorado began collecting contributions on January 1, 2023. Paid Family and Medical Leave benefits are mandatory and available to eligible employees on January 1, 2024. More information can be found here: CO PFML

Connecticut

Connecticut mandatory Paid Family and Medical Leave became available to eligible employees on January 1, 2022. More information can be found here: CT PFML

Delaware

Delaware will begin collecting contributions for its mandatory Paid Family and Medical Leave Insurance program on January 1, 2025, and benefits will be available to eligible employees one year later on January 1, 2026. More information can be found here: DE PFML

Florida

Florida passed a bill allowing insurers to offer Paid Family Leave (PFL) insurance plans. This bill does not mandate PFL coverage. More information on the bill can be found here: FL PFL

Hawaii

Hawaii has a mandatory Temporary Disability Insurance (TDI) plan, effective in 1969. There is no family leave program currently in place. More information can be found here: HI TDI

Kentucky

Kentucky passed a bill allowing insurers to offer Paid Family Leave (PFL) insurance plans, passed on April 5, 2024. The bill does not mandate PFML coverage. The bill can be found here: KY PFL

Maryland

Maryland will begin collecting contributions on October 1, 2024 to fund the mandatory Maryland Family and Medical Leave Insurance (FAMLI) program, prior to benefits starting on January 1, 2026. More information can be found here: MD FAMLI

Massachusetts

Massachusetts mandatory Paid Family and Medical Leave began paying benefits to eligible employees on January 1, 2021 for leave related to an employee’s own medical condition and to care for a new child. Benefits were available for leave for a family member with a serious health condition on July 1, 2021. More information can be found here: MA PFML

Minnesota

Minnesota has enacted mandatory Paid Family and Medical Leave legislation, with contributions and benefits beginning on January 1, 2026. More information can be found here: MN PFML

New Hampshire

New Jersey

New Jersey created a mandatory Temporary Disability Benefit (TDB) law in 1948. Family Leave Insurance (FLI) was later added in 2008. More information can be found here: NJ TDB & FLI

New York

Oregon

Oregon mandatory Paid Family and Medical Leave contributions began January 1, 2023 and benefits became available to eligible employees on September 3, 2023. More information can be found here: OR PFML

Puerto Rico

Puerto Rico has a mandatory statutory disability insurance plan in place that was passed in 1968. PR SINOT

Rhode Island

Tennessee

Tennessee passed a bill allowing insurers to offer Paid Family Leave (PFL) insurance plans, which goes into effect on January 1, 2024. This bill does not mandate PFL coverage. The bill can be found here: TN PFL

Texas

Texas passed a bill allowing insurers to offer paid family leave insurance plans. On January 1, 2024, insurance carriers can offer Texas PFL to employers on a voluntary basis. This bill does not mandate PFL coverage. The bill can be found here: TX PFL

Vermont

Vermont created a voluntary state Paid Family and Medical Leave program that became available to state employees on July 1, 2023. For employers with at least 2 employees, this program will become available on July 1, 2024; for individuals and small employers, the program will become available on July 1, 2025. Virginia

Washington

Next Steps

Employers should review the changes for 2023 and take action immediately, as applicable, for MA and DE.  Employers should also review the upcoming 2024 changes and make updates where applicable, such as payroll practices and systems and notices to employees.
